Karanataka HC observes that there is evidence against Madani | By Yentha

Bangalore: The Karnataka High Court ruled against Abdul Nasar Madani’s petition to quash the charge-sheet against him, filed by the CID in connection with the Bangalore blasts case.

The court observed that there was evidence pointing to Madani’s involvement in the case, which has to be investigated further.

The court said that evidence against Madani was available and the investigations could possibly recover more evidence. As such, any ruling to quash the charge-sheet would interfere in the case and disrupt the investigation process.

The court also said that the quashing power of the higher court could not be used to disrupt investigations, especially in a case where a heinous offence is alleged.

Counsel Ravi B Naik appearing for Madani had said that Madani was a highly respected social and political leader in Kerala, but the court ruled that these were not the criteria to consider the plea. The allegations against Madani were not simply against an individual, but against the state. The case related to an incident that questioned the security and threatened the integrity of the nation. The bench said that such an act creates panic in the minds of people about their own safety, and also threatens the economy of the country.

The court also said that such investigation needs time to collect evidence.

Witness statements reveal that Madani had interacted with the other accused in the blasts before and after the incident. The evidence also showed the assistance given to the accused to flee the country, said the court.
